Family Law Orders for Retired TRS Members
If you are an active/inactive member, click here.
TRS may be directed by a court, via a Family Law Order (FLO), to distribute a portion of your retirement benefits to an ex-spouse. A FLO must comply with all applicable law and TRS must approve each FLO submitted.
Please review the following documents for examples of how FLOs are constructed:
- Example C: TRS Sample Family Law Order - Applies to Retired Participant Who Elected a Normal Form Benefit
- Example D: TRS Sample Family Law Order - Applies to Retired Participant Who Elected Option A, B, C, D, or E and the Alternate Payee Is the Joint Annuitant
- Example E: TRS Sample Family Law Order - Applies to Retired Participant Who Elected Option A, B, or C, and the Joint Annuitant Is Not Also the Alternate Payee
- Example F: TRS Sample Family Law Order - Applies to Retired Participant Who Elected a 10- or 20-Year Term Certain and Life Benefit
If you have any questions regarding Family Law Orders and how divorce may impact your Montana TRS retirement benefit, please contact TRS.
